Scott Berinato. The article addresses the perils
of litigating software failure cases; provides
advice on how to draft contract language that
will help avoid failed computer projects; urges
the CIO to get involved early; and recommends
mediation as the first line of defense. “The

an article entitled "Information Technology Litigation and Software Failure"
which comments on the reasons for a steadily increasing volume of computer
system failure disputes and summarizes the theories of liability generally
used by litigants in software failures cases. A number of leading cases
are discussed. July 15, 2003Jeff Parmet co-authors "Protecting Intellectual Property During the Internet Age." May 13, 2003Electronic Discovery March 25, 2003 Computer system project success rates have increased to just over a third or 34%
of all projects. This is a 100% plus improvement over the 16% rate in 1994. Project failures have
declined to 15% of all projects, which is more than half the 31% in 1994. Challenged projects
account for the remaining 51%, according to Latest Standish Group CHAOS Report.
